Quality Awarness: Be aware that there is no mandatory testing for imported items. Imported bathroom faucets and shower systems can offer many advantages in function and beauty. Many items come from countries with stringent safety guidelines, while others are made in countries with no regulation at all. How can a manufacturer prove the quality of their products? Independent testing and certification by NSF or UPC/cUPC is costly but provides the manufacturer with a means of ensuring that all tested products will safely meet the needs of any customer. Certified fixtures are usually stamped with certification entity’s logo. If you aren’t sure if a product is certified, just ask for the certificate. We share ours proudly, and so will other responsible manufacturers.
Priele Bathrooms Terms of Sale:
All terms and prices apply to the most current
Priele/ catalog, pricelist and online information.
Ownership: Products are shipped FOB
Miami. Purchaser takes title and ownership when paid merchandise is moved from
Priele warehouse to a freight carrier.
Freight: Priele uses
standard freight systems and shipping will be shown on the customer invoice.
Pricing: Prices are subject to change
without notice; updated price lists supercede all prior price lists.
Payment Terms: Unless specifically
authorized in advance and in writing, all invoices will be paid in full prior to
the shipment of any merchandise. In the event payment is not made when due,
interest will accrue on the unpaid invoice from the date due, at 18% per annum,
or the maximum allowed by law. Interest will be paid on the customer’s next
remittance. The assessment of interest is in addition to all other rights and
remedies of Priele with respect to non payment and default.
In addition to interest charges customer agrees to pay all collection costs and
expenses of unpaid balances due. Delinquent accounts will be put on hold and no
merchandise will be shipped until the account becomes current, at which time the
account will be reevaluated. No RGA’s will be issued, or replacement parts will
be sent until all outstanding balances are paid in full.
Any and all unpaid merchandise is property of
Developers Line LLC until fully paid. Products must be granted an RGA prior to
return. Return shipping cost is the responsibility of the purchaser. Returned
merchandise must in new condition and in the original packaging, and will be
subject to a re-stocking fee. Returned merchandise represented as like new and
found to be otherwise will not be eligible for a credit and will be returned to
the sender at the sender’s expense.
Design Changes: With the objective of
incorporating new features and updated style Priele
reserves the right to revise the design, color, size or packaging without
notice. Natural products will have a natural variance which is not considered a

Transit Damage: All reasonable efforts
are made to ensure that Priele are protected during
shipping. It is the purchaser’s obligation to inspect goods on receipt and
check for damage or shortage. Identified damage should be noted on the bill of
lading before accepting the merchandise. Priele must be
contacted immediately for further action. Concealed damage must be reported to
Priele with 24 hours of documented receipt of such
Limitations on Damages: Priele shall not be liable for any indirect, incidental or consequential loss
or damage (including without limitation, labor costs associated with any
defective product, loss of profits or loss of use) suffered by any party arising
or relating to Priele performance, non-performance, breach
of or default under a covenant, warranty, representation, term or condition
hereof. Purchaser waives and relinquishes all claims for indirect, special,
incidental or consequential damages. Purchaser shall not have the right to
recover punitive damages form Priele and purchaser hereby
waives and relinquishes and all punitive damage claims. The limitations on
liability and damages set forth herein apply to all causes of action that be
asserted hereunder, whether sounding in breach of contract, breach of warranty,
tort, product liability, negligence or otherwise. Any arbitration litigation,
judicial reference, mediation, or other legal proceeding shall be commenced with
one year after the accrual of the cause of action. Venue for any legal actions
shall be Miami/Dade County, Florida.
